This Privacy Policy describes how Studio 639-Tonia DeBellis (“Tonia DeBellis,” “we,” “us,” and “our”) collects, uses and discloses customer information. We use Google Analytics to track traffic and collect information about how visitors use our website. Google Analytics use cookies to collect information, including pages visited and where users come from, in an anonymous way. “Log files” track actions occurring on the Site, and collect data including your IP address, browser type, Internet service provider, referring/exit pages, and date/time stamps.   

“Web beacons,” “tags,” and “pixels” are electronic files used to record information about how you browse the Site.

Additionally when you make a purchase or attempt to make a purchase through the Site, we collect certain information from you, including your name, billing address, shipping address, payment information (including credit card numbers, email address, and phone number.  We refer to this information as “Order Information.”

“Personal Information” referenced in this Privacy Policy refers to Device Information and Order Information.

How Do We Use Your Personal Information?

Order Information is used to fulfill any orders placed through the Site (including processing your payment information, arranging for shipping, and providing you with invoices and/or order confirmations).  Additionally, we use Order Information to:

  • Communicate with you;
  • Screen our orders for potential risk or fraud; and
  • In the case that you Opt In to receiving marketing messages or update your preferences to receive marketing messages, we provide you with information or advertising related to Tonia DeBellis products or services.

We use the Device Information to screen for potential risk and fraud (using your IP address), and improve and optimize our Site (for example, by generating analytics about how our customers browse and interact with the Site, and to assess the success of our marketing and advertising campaigns).

 

2. INFORMATION SHARING WITH THIRD PARTIES

If you are a European resident, you have the right to access personal information we hold about you and to ask that your personal information be corrected, updated, or deleted. If you would like to exercise this right, please contact us through the contact information below.

Additionally, if you are a European resident we note that we are processing your information in order to fulfill contracts we might have with you (for example if you make an order through the Site), or otherwise to pursue our legitimate business interests listed above. Your information will be transferred outside of Europe, including to Canada and the United States.

 

5. DATA RETENTION

When you place an order through the Site, we will maintain your Order Information for our records unless and until you ask us to delete this information.

 

6. AGE REQUIREMENT

The Site is not intended for individuals under the age of 13. Purchases made by persons under the age of 18, must be made with a parent or guardian's consent; however Tonia DeBellis will not be held responsible for purchases made by underage users.

 

7. SECURITY

We take reasonable precautions and abide by standard industry practices to assist us in protecting your personal information and payment card data. These safeguards help us to prevent fraud and unauthorized access, as well as maintain data accuracy.

 

8. LINKS TO OTHER WEBSITES

The Site and/or Service contain links to other sites that are not owned or controlled by Tonia DeBellis, such as our Store Locator page. Please be aware that this Privacy Policy applies only to information collected by Tonia DeBellis, and we are not responsible for the privacy policies and practices of other sites. When you leave the Site, be aware to read the privacy policies of each and every website.

  

9. MODIFICATION OF THIS PRIVACY POLICY

If we decide to change this Privacy Policy, we will post those changes on this page, with the “Effective Date” posted at the top of the Privacy Policy. Mobile Terms of Service

The Tonia DeBellis mobile message service (the "Service") is operated by Tonia DeBellis (“Tonia DeBellis”, “we”, or “us”). Your use of the Service constitutes your agreement to these terms and conditions (“Mobile Terms”). We may modify or cancel the Service or any of its features without notice. To the extent permitted by applicable law, we may also modify these Mobile Terms at any time and your continued use of the Service following the effective date of any such changes shall constitute your acceptance of such changes.

By consenting to Tonia DeBellis’s SMS/text messaging service, you agree to receive recurring SMS/text messages from and on behalf of Tonia DeBellis through your wireless provider to the mobile number you provided, even if your mobile number is registered on any state or federal Do Not Call list. Text messages may be sent using an automatic telephone dialing system or other technology. Service-related messages may include updates, alerts, and information (e.g., order updates, account alerts, etc.). Promotional messages may include promotions, specials, and other marketing offers (e.g., cart reminders).

You understand that you do not have to sign up for this program in order to make any purchases, and your consent is not a condition of any purchase with Tonia DeBellis. Your participation in this program is completely voluntary.

We do not charge for the Service, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message frequency varies. Message and data rates may apply. Check your mobile plan and contact your wireless provider for details. You are solely responsible for all charges related to SMS/text messages, including charges from your wireless provider.

You may opt-out of the Service at any time. Text the single keyword command STOP to Tonia or click the unsubscribe link (where available) in any text message to cancel. You'll receive a one-time opt-out confirmation text message. No further messages will be sent to your mobile device, unless initiated by you. If you have subscribed to other Tonia DeBellis mobile message programs and wish to cancel, except where applicable law requires otherwise, you will need to opt out separately from those programs by following the instructions provided in their respective mobile terms.

We may change any short code or telephone number we use to operate the Service at any time and will notify you of these changes. You acknowledge that any messages, including any STOP or HELP requests, you send to a short code or telephone number we have changed may not be received and we will not be responsible for honoring requests made in such messages.

The wireless carriers supported by the Service are not liable for delayed or undelivered messages. You agree to provide us with a valid mobile number. If you get a new mobile number, you will need to sign up for the program with your new number.

To the extent permitted by applicable law, you agree that we will not be liable for failed, delayed, or misdirected delivery of any information sent through the Service, any errors in such information, and/or any action you may or may not take in reliance on the information or Service.
